**RENTAL AGREEMENT AND TERMS**

**RENTAL AGREEMENT PARTIES AND PURPOSE**

This agreement is made between the party renting the “VILLA/APARTMENT” (hereinafter referred to as the “RENTER”) and the party leasing the “VILLA/APARTMENT” (hereinafter referred to as “VILLAMINE”) for a specified period, with start and end dates predetermined by both parties, for the rental of the “VILLA/APARTMENT.” Renters and their companions who make a reservation for any of our villas/apartments through our website “www.villamine.com,” by phone, or via email are deemed to have accepted the following terms. In case of any violation of the conditions mentioned below, “VILLAMINE” reserves the right to unilaterally cancel the rental, demand the renter to vacate the villa/apartment, withhold the deposit, and claim the full unpaid rental amount.

**RESERVATION AND PAYMENT**

Reservations for our villas/apartments marketed by us can be made through the reservation form on our website, by phone, or via email. “VILLAMINE” completes the rental process by specifying the desired rental dates and obtaining the necessary contact and billing information from you. After the rental process is completed, “VILLAMINE” collects 40% of the total rental fee as a deposit for the villa/apartment. If the deposit is paid within 1 business day after the rental process, the villa/apartment will be reserved under your name. The deposit amount and our bank account numbers will be communicated to you via email, SMS, or phone. The deposit must be paid via bank transfer or EFT within 1 business day. Written confirmation of the villa/apartment rental will be sent to you within 1 business day of receiving the deposit. The confirmation will include the total rental fee, the deposit paid, the rental dates, and the date and time the deposit was received. If the deposit is not paid, “VILLAMINE” reserves the right to cancel the preliminary reservation and accept other reservations for the villa/apartment without notifying the renter. The remaining balance of the rental fee is payable in cash (in cash) upon villa/apartment handover after inspection. Additionally, due to the villa/apartment being rented furnished, a damage deposit of 500 TL/2000 TL is required and payable in cash (in cash) at the time of villa/apartment handover. The damage deposit will be refunded to the renter upon departure after the inventory count if there are no damages or losses. To prevent any inconveniences, it is essential to have the necessary amounts in cash on the villa/apartment check-in day.

**CHECK-IN AND CHECK-OUT TIMES**

On the reservation start date, the earliest check-in time is 16:00, and the latest is 21:00. Renters cannot check in outside the specified hours. If the renter arrives after the latest check-in time, they can check in the next morning at the start of “VILLAMINE” working hours (08:30). “VILLAMINE” is not responsible for issues arising from the renter's inability to check in before or after the specified hours, such as finding accommodation for the night. The renter must find and pay for their accommodation for the night in such situations. “VILLAMINE” is not responsible for these situations. Check-out time on the reservation end date for all regions is no later than 10:00 AM. The renter is fully responsible for any problems, damages, or inconveniences caused by not vacating the villa/apartment by 10:00 AM, and “VILLAMINE” is entitled to seek compensation for any resulting financial losses. Early check-out requires 24-hour notice to “VILLAMINE.” If the renter leaves the villa/apartment without a proper check-out due to high occupancy, the damage deposit will be transferred to a bank account provided by the renter. No refund will be made for early departure at the renter's request.

**VILLA/APARTMENT CAPACITY**

Our villas/apartments do not accept guests exceeding the capacity specified on our website or the number of people indicated during the reservation (including children and infants). If the renter wishes to change the number of people after the reservation is finalized, they must apply in writing to “VILLAMINE,” and the change will be approved based on the villa/apartment capacity. Additional fees may apply. No additional guests outside those listed in the reservation are allowed after check-in. If this is violated, “VILLAMINE” reserves the right to request the additional guests to leave, cancel the reservation entirely, or demand the villa/apartment be vacated immediately, without waiting for the rental period to end, and claim full payment and additional fees. The renter is responsible for providing accurate and complete information during the rental process.

**VILLA/APARTMENT CLEANING, MAINTENANCE, AND EXTRA EXPENSES**

The rental rates for daily, weekly, and monthly villa/apartment rentals include an initial cleaning. For stays of 2 weeks or more, weekly cleaning and towel/sheet changes are included. Any additional cleaning or towel/sheet changes will incur extra charges. Pool and garden maintenance are done early every morning, and any technical issues that arise during the rental period will be addressed by the owner. “VILLAMINE” is not responsible for these issues but will assist in resolving them. Maintenance personnel must enter the villa/apartment or garden for periodic maintenance of pools, gardens, and other fixtures. Renters must allow maintenance personnel to enter the villa/apartment when necessary. Unless otherwise stated on the villa/apartment details page on our website, electricity, water, gas, pool lighting, internet connection, and air conditioning usage are included in the rates. Not all villas/apartments have standard pool lighting, air conditioning, and internet, so renters should carefully read the villa/apartment features on our website.

**PETS/SMOKING**

Unless otherwise stated, pets are not allowed in our villas/apartments.

Smoking is prohibited in all indoor areas of our villas/apartments.

**PRICES**

The rental rates for villas/apartments listed on our website are daily, weekly, and monthly. Deposits can be made via bank transfer or EFT to our bank accounts.

**RENTAL/PAYMENT/CANCELLATION TERMS AND REFUND CONDITIONS**

The deposit amount paid for the villa/apartment rental (via EFT, bank transfer, or mail order) will not be refunded for cancellations made up to 30 days before the villa/apartment check-in date. This is because the entire payment has been made as an advance payment to the villa/apartment owner. The remaining amount must be paid upon check-in.

The renter can cancel their trip before it starts. Cancellation must be notified to “VILLAMINE” in writing, and verbal cancellations will not be accepted.

In case of cancellations, “VILLAMINE” will deduct certain percentages from the total service amount specified in the travel agreement to cover the measures and expenses incurred for the trip. These amounts are determined as follows:

- a. The 40% deposit collected for the villa rental is non-refundable.
- b. If the villa rental is canceled up to 30 days before the check-in date, 40% of the rental amount is payable.
- c. If the villa rental is canceled within 29 days before the check-in date, 100% of the rental amount is payable.
- d. If “VILLAMINE” cancels the rental for any reason, this will be communicated to the renter as soon as possible. If there is another villa with similar features available in our portfolio for the same period, it will be offered to the renter. In case of force majeure (earthquake, flood, disaster, etc.), the entire payment will be refunded to the guest.
- e. No refunds will be made if the renter does not show up at the specified villa or leaves early after making a reservation through “VILLAMINE.”
- f. If there is a specific cancellation policy for certain villas/apartments in our portfolio, it will be specified in the villa information section.
- g. Refund requests must be made in writing via mail or registered mail, and they will be valid from the moment they reach us.
- h. If the renter fails to make the remaining payment on time after paying the deposit, “VILLAMINE” reserves the right to rent the specified villa to other individuals.

**DAMAGE DEPOSIT**

A different damage deposit amount will be collected from the renter depending on the villa/apartment features. This deposit amount will be stated in the confirmation document sent to the renter during the reservation process. The damage deposit will be collected in cash on the villa/apartment check-in day and refunded in cash after inspection if there is no damage or missing items. If the renter wants to leave the villa/apartment earlier than specified or if the villa/apartment check-out inspection cannot be done due to high occupancy, the deposit will be transferred to a bank account provided by the renter. If the damage exceeds the deposit amount, the renter will be asked to pay for the damage, and legal action will be taken if necessary.

**SWIMMING POOLS**

The temperature of the swimming pools in our villas/apartments varies according to weather conditions and seasonal temperatures. The renter cannot hold “VILLAMINE” responsible for not using the pool due to cold water. Renters can check the weather conditions for the rental dates by visiting the State Meteorological Service website or calling the State Meteorological Service.

OUR RESPONSIBILITIES AND GUARANTEE

VİLLAMİNE is responsible for delivering the villa/apartment to the tenant clean and ready for use at the specified date and time. Upon entering the villa/apartment, if there are any damaged or non-working items or issues, the tenant must immediately notify VİLLAMİNE and request that these issues be resolved. VİLLAMİNE will inform the owner of the villa/apartment or the relevant company of this request and ensure that the issue is resolved within 48 hours at the latest. VİLLAMİNE is not responsible for resolving the issue but assists in its resolution. VİLLAMİNE cannot be held responsible for issues not reported in a timely manner. VİLLAMİNE is an intermediary between the villa/apartment owner and the tenant, and therefore, the villa/apartment owner is responsible for resolving any issues that may arise in the villa/apartment. Furthermore, VİLLAMİNE cannot be held responsible for any accidents, illnesses, injuries, drowning in the pool, deaths, etc., and incidents such as fire, theft, etc., that may occur in the villa/apartment, which are under the tenant's responsibility. Additionally, VİLLAMİNE will not be responsible for any problems arising from services such as travel, shopping, food, drink, entertainment, transportation, travel, and guidance services that tenants may receive from third parties/companies during their holiday. The tenant cannot claim any rights or refunds for a service not received due to an issue or malfunction that they did not report to VİLLAMİNE during their stay in the villa/apartment after leaving the villa/apartment.

INVOICE - TAX

None of the villas or apartments published on VİLLAMİNE's website belongs to VİLLAMİNE. Each villa/apartment has different owners, individuals, or companies. VİLLAMİNE is an intermediary (commission agent) for renting villas/apartments from individuals, persons, or companies to tenants. Therefore, VİLLAMİNE only issues an intermediary (commission) invoice. In other words, VİLLAMİNE earns a certain intermediary (commission) profit from the tenant's payment and issues an invoice for this profit. The remaining profit is the villa/apartment owner's profit; therefore, no invoice is issued for the remaining amount. The villa/apartment owner pays their tax at the end of the year under the name of rental income declaration. VİLLAMİNE is only obliged to issue an invoice for its own earned profit. TENANT'S RESPONSIBILITIES

Tenants are obliged to use the villa/apartment, the pool, garden furniture, all electrical and electronic devices, and other furniture delivered to them in working and intact condition cleanly. In villas defined as conservative (pools not visible from outside) on the website, VİLLAMİNE does not guarantee invisibility in villas without the statement "100% sheltered." Tenants are responsible for ensuring their own privacy and security measures in cases of exposure to visibility, theft, and other criminal elements. VİLLAMİNE does not accept responsibility for such problems and cannot be held responsible for them.

FORCE MAJEURE

In cases considered as force majeure, VİLLAMİNE may unilaterally terminate this contract without any legal liability. Situations such as war, threat of war, uprising, strikes, natural disasters, fires, terrorist activities, epidemics, technical problems in transportation in the region or country, infrastructure and superstructure works carried out by municipalities or public institutions, prohibitions by state officials in the region, and all unforeseeable and uncontrollable events will be considered as force majeure.

COMPLAINTS

Tenants must report their complaints to VİLLAMİNE during their stay in the villa/apartment. The situation subject to complaint will be examined by VİLLAMİNE staff, and necessary measures will be taken immediately. 15) VİLLAMİNE cannot be held responsible for situations such as no mobile phone signal, weak mobile phone signal, or no internet access from the mobile phone inside the villa/apartment or on the road.
